These General Terms and Conditions of Sale govern purchases made through www.cantina-online.com.
Customers are advised to read these Terms and Conditions carefully before placing an order.
2. Scope
These General Terms and Conditions apply to purchases made through Cantina Online by consumers and, where compatible, by business customers.
A “Consumer” is a natural person who makes a purchase for purposes unrelated to any business, commercial, craft or professional activity they may carry out.
Consumers are entitled to the mandatory protections provided by Italian Legislative Decree No. 206/2005 (Consumer Code) and applicable European consumer protection legislation.
3. Product Characteristics and Availability
Cantina Online mainly sells wines, sparkling wines, spirits, liqueurs, beverages and other food products.
The essential characteristics of each product are described on the relevant product page.
Product photographs are for illustrative purposes. Labels, packaging, colours, vintages and other elements may differ from the images displayed on the website, particularly where changes have been made by the manufacturer.
Product availability displayed on the website is regularly updated. However, a product may occasionally become unavailable after an order has been placed due to simultaneous orders, inventory discrepancies or other exceptional circumstances.
In such cases, the Customer will be informed promptly and any amounts already paid for unavailable products will be refunded in accordance with applicable law.
4. Sale of Alcoholic Beverages and Minimum Age
Alcoholic beverages are sold exclusively to persons who have reached the minimum age required under the applicable legislation.
For purchases made in Italy, the Customer must be at least 18 years old.
By placing an order containing alcoholic products, the Customer declares, under their own responsibility, that they meet the applicable legal age requirements.
The Seller reserves the right to verify the age of the purchaser or recipient. Where required or permitted by law, such verification may also be carried out by the carrier upon delivery.
Where the required age cannot be verified when necessary, delivery of alcoholic products may be refused.
5. Ordering Process
To make a purchase, the Customer selects the desired products and adds them to the shopping cart.
Before confirming the order, the selected products, quantities, prices, shipping charges and any other applicable costs are displayed.
The Customer is responsible for carefully checking the information entered before confirming the order.
Submitting an order entails an obligation to pay where this is clearly indicated during the purchasing process.
After the order has been received, the Customer will receive confirmation at the email address provided.
6. Prices
Prices published on the website are expressed in Euro (€) unless otherwise indicated.
Where Italian VAT applies, prices displayed to consumers include VAT unless otherwise clearly indicated on the website.
Before the order is confirmed, the total price of the products, shipping charges and any other applicable costs are displayed.
In the event of an obvious material error in a published price, the Seller will inform the Customer before processing the order.
7. Payments
The payment methods currently available are displayed to the Customer during checkout.
Depending on the method selected, payment may be processed directly by specialised payment service providers.
Cantina Online does not store complete payment card details where the transaction is processed directly by the relevant payment service provider.
8. Shipping and Delivery
Orders are delivered to the address provided by the Customer during the purchasing process.
Shipping costs are displayed before the final confirmation of the order.
Any delivery times shown on the website are subject to applicable law and may be affected by public holidays, destination, product availability or circumstances beyond the Seller's direct control.
The Customer is responsible for providing a correct and complete delivery address and, where requested, a telephone number suitable for delivery purposes.
9. International Deliveries, Customs Duties and Taxes
Shipments outside the European Union may be subject to customs duties, local taxes, excise duties and other charges imposed by the country of destination.
The application and payment of such amounts depend on the laws of the destination country and on any specific conditions communicated to the Customer during the purchasing process.
The Customer is also responsible for checking any restrictions or prohibitions concerning the importation of alcoholic beverages into the destination country, without prejudice to any mandatory obligations imposed on the Seller by applicable law.
10. Inspection of Goods upon Delivery
Upon delivery, Customers are advised to check:

If visible damage is present, the Customer is advised to make a specific written reservation with the carrier, clearly describing the problem identified.
This inspection facilitates the handling of claims against the carrier and does not restrict any mandatory rights granted to Consumers by law.
11. Damaged or Incorrect Products
If the Customer receives damaged, broken or incorrect products, they are advised to contact Customer Service promptly at:

All rights granted to Consumers under applicable law remain unaffected.
12. Right of Withdrawal
Consumers purchasing at a distance have, where provided by law, the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, acquires physical possession of the goods.

13. Return of Products
Following the exercise of the right of withdrawal, products must be returned within 14 days from the date on which the withdrawal was communicated, in accordance with applicable law.
Products must be returned intact and adequately protected for transportation.
The Consumer is responsible for any reduction in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics and functioning.
The direct cost of returning the goods is borne by the Consumer unless otherwise stated by the Seller or required by law.
14. Exceptions to the Right of Withdrawal
The right of withdrawal may be excluded in the circumstances provided for by Article 59 of the Italian Consumer Code.
In particular, where the relevant legal requirements are met, the right of withdrawal may not apply to goods made to the Consumer's specifications or clearly personalised, or to goods liable to deteriorate or expire rapidly.
Any applicable exclusion will be communicated to the Customer where relevant to the product purchased.
15. Refunds
Where the right of withdrawal has been validly exercised, the Seller will refund payments received from the Consumer in accordance with applicable law.
Where possible, refunds will be made using the same payment method used for the original purchase, unless otherwise agreed with the Customer.
Where permitted by law, the Seller may withhold the refund until the goods have been received or until the Consumer provides evidence that the goods have been returned, whichever occurs first.
16. Legal Guarantee of Conformity
Consumers are entitled to the legal guarantee of conformity provided for under the Italian Consumer Code.

20. Applicable Law
These General Terms and Conditions of Sale are governed by Italian law.
Consumers habitually resident in another Member State of the European Union retain the benefit of any mandatory consumer protection provisions afforded by the law of their country of habitual residence.
21. Jurisdiction
For disputes relating to contracts concluded with Consumers, the court having jurisdiction shall be the court of the Consumer's place of residence or domicile where required by applicable law.
For relationships with persons who do not qualify as Consumers, the applicable statutory rules on jurisdiction shall apply unless the parties have entered into a different valid agreement.
22. Amendments to these Terms and Conditions
The Seller may update these General Terms and Conditions of Sale to reflect changes in legislation, organisation or the services offered.
Each order is governed by the Terms and Conditions in force and made available to the Customer at the time the contract is concluded.
